In our last blog post, we talked about what requirements will be necessary for start-ups with the AI Act in the future. This time, we will talk about the challenges that this brings with it. Since each challenge also offers opportunities, we will also discuss these and summarise the most important things in the conclusion.

Future challenges and opportunities The ongoing development and diffusion of AI technologies presents both challenges and opportunities. For startups and SMEs, the new regulatory framework, particularly with regard to liability and data protection, gives rise to numerous aspects that should be taken into account.

With regard to liability, it may be necessary to rethink business models and make adjustments. The risk of liability for damage caused by AI systems, for example, can be covered by appropriate insurance policies. It is important that start-ups and SMEs are informed about these aspects and take appropriate measures in good time. With regard to data protection, companies need to familiarise themselves with the new regulations and ensure that their AI systems comply with them. Compliance with data protection regulations is not only legally binding, but can also strengthen customers' trust in the company and thus contribute to its success.

Conclusion The AI Act and the proposed AI Liability Directive place new requirements on companies that use or develop AI technologies. It is important that these companies address the new regulatory framework early on and take appropriate steps to minimise the associated risks. The challenges are great, but at the same time the new legislation also offers opportunities. Companies that manage to adapt their AI systems to the new requirements and successfully master the regulatory challenges can gain a decisive competitive advantage. It remains to be seen how the situation will develop in the coming years. What is already clear, however, is that artificial intelligence will play an increasingly important role and companies that successfully use this technology have the opportunity to benefit from the numerous advantages it offers. It is therefore all the more important to take the regulatory challenges seriously and actively address them.
